The agreement between Fuel Taxi and every customer using the platform. The short version: Fuel Taxi connects you to independent fuel delivery operators. They fulfill your orders. We handle the platform, the payments, and the communication. By using the app, you agree to these terms.
Fuel Taxi, LLC ("Fuel Taxi," "we," "us," or "our") operates a technology marketplace platform that connects customers with independent local fuel delivery businesses ("Fuel Pros"). Fuel Taxi is not a fuel delivery company. Fuel Taxi does not own, operate, employ, or control the trucks, drivers, fuel, or fuel-handling equipment used to perform deliveries. The Fuel Pro you select is an independent business operating under its own name, with its own personnel, insurance, licenses, permits, and operational responsibility.
By creating an account or using the Fuel Taxi platform (the "Platform"), you acknowledge and agree that:
To use Fuel Taxi, you must create an account and be at least 18 years of age. By creating an account, you represent that you are 18 or older and legally able to enter into this agreement. You agree to:
Fuel Taxi may suspend, restrict, or terminate your account at our discretion for violations of these Terms, fraudulent or unlawful activity, abuse, non-payment, or conduct that puts other users, Fuel Pros, or the public at risk.
Each Fuel Pro independently sets their own fuel rate (per gallon) and delivery fee. Fuel Taxi adds a platform fee of four percent (4%) at checkout, capped at thirty dollars ($30) per order, paid by the customer. Applicable taxes may also apply and are the responsibility of the Fuel Pro to assess and remit where required. The complete price breakdown is displayed to you before you confirm any order.
When you place an order, your payment method is pre-authorized for the estimated total, which includes a buffer above the estimated fuel cost. The final charge is captured only after the delivery is complete and reflects the actual gallons delivered plus applicable fees. Any unused portion of the pre-authorization is released back to your payment method on your card issuer's standard timeline — typically same-day for debit cards and 3–5 business days for credit cards.
You are responsible for ensuring that your saved vehicle and equipment information, delivery addresses, and selected fuel types are accurate and complete. Your Fuel Pro fuels what you have selected in the app.
Any tip you provide goes one hundred percent (100%) to the driver who fulfilled your order. Fuel Taxi never retains any portion of a tip.
When placing an order on Fuel Taxi, you agree to:
You understand that the delivery and handling of fuel involves inherent risks. Fuel is a flammable, hazardous material. By using the Platform to request fuel delivery, you acknowledge these risks and agree that the Fuel Pro fulfilling your order — not Fuel Taxi — is responsible for the safe handling, transport, and dispensing of fuel.
You agree to follow all reasonable safety instructions provided by the Fuel Pro or driver, to keep people and pets a safe distance from the fueling area during delivery, and to disclose any condition at the delivery location that could affect safe fueling. You assume responsibility for the accuracy of the information you provide and for the suitability of your vehicle, equipment, and location for in-place fueling.
Each Fuel Pro operates as an independent business. This means:
You may cancel an order at any time before the assigned driver begins fueling. Depending on how far along the order is, a small failed-delivery or trip fee may apply if cancellation occurs after the Fuel Pro has been dispatched but before fueling has begun. The specific cancellation terms for each Fuel Pro are visible on their store page.
If a delivery is completed but the gallons delivered are less than the pre-authorized estimate, the difference is automatically released back to your payment method. If a delivery is not completed due to an issue caused by Fuel Taxi or the Fuel Pro, you will not be charged for the undelivered fuel. Refund requests related to a Fuel Pro's performance are handled in coordination with that Fuel Pro.
To the maximum extent permitted by applicable law:
You agree to indemnify, defend, and hold harmless Fuel Taxi, LLC, its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) inaccurate information you provided, including incorrect vehicle, equipment, fuel-type, or address information. This obligation survives the termination of your account and these Terms.
All Fuel Taxi software, technology, design, brand assets, name, logo, and trademarks are the sole property of Fuel Taxi, LLC. By using the Platform, you do not acquire any ownership rights in any Fuel Taxi intellectual property. You may not reverse engineer, decompile, copy, or attempt to derive the source code of the Platform. You may not use the Fuel Taxi name, logo, or brand assets without express written permission.
If you have an issue with a delivery, contact your Fuel Pro through in-app messaging first, and report the issue to Fuel Taxi as well. Most issues are resolved this way. Before initiating arbitration, you agree to first contact us at legal@fueltaxi.com and allow at least sixty (60) days to resolve the matter informally.
Any dispute that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not in court, except as otherwise provided herein. The arbitration will take place in the State of Wisconsin, or via remote/virtual proceedings where available. You and Fuel Taxi waive the right to a jury trial.
You and Fuel Taxi agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
This arbitration provision does not prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters such as intellectual property protection or unauthorized access to the Platform.
Fuel Taxi is not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, fuel shortages, supply chain disruptions, labor disputes, power or internet outages, government actions, or the unavailability of third-party service providers.
Fuel Taxi may modify these Terms from time to time. Material changes will be communicated through the app or by email at least thirty (30) days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
You may close your account at any time through the app. Fuel Taxi may suspend or terminate your account for violations of these Terms, fraudulent activity, abuse, safety concerns, or conduct that risks harm to other users, Fuel Pros, or the Platform. Provisions that by their nature should survive termination — including limitation of liability, indemnification, and dispute resolution — will survive.
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-laws principles. Subject to the arbitration provision in Section 11, any dispute that proceeds in court shall be brought exclusively in the state or federal courts located in Ozaukee County, Wisconsin, and you consent to the personal jurisdiction of those courts. Fuel Taxi currently operates in the United States only.
